I agree, it's not like looking at a Rand McNally while driving was illegal, or using the damn car radio, or changing a cassette or CD was illegal - though I won't argue that they take your eyes off the road. So does eating a burger, drinking, and reaching for those items from the cupholder or passenger seat, chatting with a passenger and occasionally looking at them... this isn't behavior that causes cars to collide, or leave the road. It's merely being relaxed at the wheel, and experienced at driving, and able to maintain your cars direction, lane use, and velocity, while doing other things.
the California Court of Appeal for the sixth appellate district concluded that the term “operating” under the aforementioned law “prohibits all use of a handheld phone’s functions while driving, including looking at an application on the phone.”
That the state law prohibits the handheld use of cellphones while driving applies to holding phones operating as navigation systems.

Damn! More govt bullshit in order to ticket tax vehicle operators with traffic cameras! Using a map is not TALKING on a phone, it's not as damn distracting!

I just thought you oughta know about this. I doubt it's going to make mainline news
I guess having a GPS unit sitting on your dashboard at different locations every time you plugged it into the cigarette liter would be a problem. The VA in Wichita gave me one I finally used it. Man was I ever sold! It was a GARMIN and their home office and factory was in that Kansas area. Got to where it was acting up so I stopped by. Told me to go eat lunch while they reloaded the program. Got back and set it was bad when I got it and handed me brand new one in the box. If I build my roadster I would probably get a dash mounted one. That is really a great company and yes, that is a sales pitch for them.
ReplyDeleteyou bring up a great point, Garmin is a great company! Also, I felt bad that the proliferation of cell phone maps (Google Maps) might put them out of business... because Garmin dominated the GPS market in that small time frame between AAA road strips, Rand McNally road atlas, and Thomas Brothers Guide paper maps - and the smart cell phone / factory installed touch screen in the dash GPS.
DeleteI'm glad to hear they hooked you right up, straight away properly dealt with a glitchy unit, and that you told me about your experience with them!
Also, that brings up the question, if the courts of California find that using a hand help GPS on your phone is illegal, what is their determination on touchscreen GPS in the vehicles, and how many of those court members are using the GPS and cell phone Google Maps when they drive to places new to them? Damn all hypocrites to naked sitting on ice blocks!
Set the phone in some sort of 'holder' and no prob. I have seen drivers with a book open on the steering wheel and a UPS driver with a newspaper open reading while driving. Yes I did call UPS with the ID info on the truck.
