6 months after losing the small claims court case, they sent me the check. Bizarre
just out of the blue, with no reason to wait until now, and no actions on my part to remind them to pay me. Bizarre, but, I never thought I'd get paid. So, that's finally done with
I had a similar experience years ago. I took a Mercury dealer in SoCal to small claims for the money I spent to replace 4 defective tires on a new Lynx I has purchased. They never showed up in court so I won the case.But they never paid either. Then about 3 years later they sent the money. Turns out they were selling the dealership and couldn't complete the transfer until they paid all the claims they never paid.
yes, with a lien filed on their property, they must pay out before they can sell.... but I hadn't gotten around to filing a lien, because I'm certain this company isn't selling for decades to come as it's the 2 nd generation already moving into management as the original guy is retiring. So, never going to sell, as it's the family business and way they earn money for everyone in the family, the dad started it, the mom is the office manager, the son is now taking over management... so I had not bothered filing, as I was also certain they were simply never going to pay. I took them to court out of principle, not out of need to see them pay. So, I was shocked when they took 6 months of nothing occurring to motivate them, resulting in them doing nothing, but then for no apparent reason, sending me the check. Anyway, about a dozen years ago I was doing part time weekend job helping with the restoration of 1969 Corvettes, and they gave me a bad check because this husband and wife were terrible with money, and wouldn't get a real job, neither of them. So the check for about 350 bounced, and I did all the small claims court stuff, and filed everything, and about 8 or 9 years later they needed to sell their house, and their lawyer got in touch with me and I got paid finally. It's rare to get paid... but sure feels great! Damn, 4 bad tires? Wow... that's terrible! Glad you finally got paid!
I never filed a lien, just got a call from a lawyer to ask where to send the check and why they needed to clean up the matter. Never bought another Mercury either.
Good for you! My wife hit a 10" pothole in Syracuse a couple of years ago blowing out the sidewall on her new low profile front tires. We called the city and sent a couple of letters with the cost of the repair. They responded through their attorney they weren't responsible. About a half a half year later we received a check for the full amount in the mail. Never expected that one
