Court rules red-light camera law unconstitutional, dismisses ticket


A Broward County judge has dismissed a red-light camera ticket, ruling that the state law used to issue the citation improperly shifts the burden of proof onto vehicle owners.

Automated cameras captured a vehicle entering an intersection against a red signal. The defendant argued the statute unconstitutionally requires the registered owner to prove they were not driving — instead of requiring the government to prove who was behind the wheel.

  1. Solution: separate camera aimed at the driver's door so that it can be seen who was at the wheel. The problem is that accidents occur because of these red light violators. Another thing to do is to be sure that the yellow light is 4 to 5 seconds long instead of three seconds.

    1. The only real solution to intersections being dangerous, is to get rid of the stop lights, and put in a cop. Everyone has to stop at the stop sign, and the cop is there to make sure they do.
      I do believe, that puts every car at a vary safe speed, and only after coming to a complete stop.
      Can you find any fault in that idea?
      And this is the proof (if I'm right that my idea would work perfectly) that cameras are NOT installed for safety. They are installed to make money for the city.
      Because if the problem really is safety, then the solution really isn't cameras, it's cops.
      And fine, instead of every car coming to a stop, the cop can go back to traffic control, and let a lot move through at one time, from one direction, then stop them and let another go.
      I have been a cop in the middle of an intersection many times, directing traffic the old fashioned way, with hand signals and a coach's whistle.
      4 lane roads, 2 heading in one direction opposite 2 others, and a turn lane in between.
      People do not blow through an intersection when a cop is standing in it.
      Also, cameras can not prove who is driving when the driver is smart enough to wear a mask. That's been proven, I posted about that in about 2021.
      So, the cops could not pin the owner for the ticket, they couldn't prove who the driver was.
