BMW is facing a class action lawsuit, but I bet the law firm bringing this suit will settle for a nice out of court lump sum


BMW is facing a class-action lawsuit in California, which states that the BMW X7 has a design flaw that involves cupholders – they are not allowed to get wet. "cup holders are defective and are not properly designed to hold cups filled with liquid — the very thing cup holders are intended to do."

"When liquid spills into the cup holder, the wires for the SRS (airbag) control module, which sits directly underneath cup holder, get wet and are damaged, causing damage to the airbags. As a result, the airbags can inadvertently deploy," the complaint said.

Replacement and repair costs of the module go over $2,000, which, in some cases, BMW refused to cover under warranty.

  2. While I may hate the tort bar an airbag control module should not be under a cup holder. Plain common sense.

  3. If these attorneys were serious, the dollar amount would be a lot higher than $5M. This is a couple people looking to get their repair bills paid.
    Hard to believe BMW will even consider taking this seriously enough to do a design change. Design change and retrofit will cost a lot more than a paltry $5M. GM's Bolt recall is costing them $5BILLION with a B!
