trucker vs little car who knows one thing the trucker doesn't

Though the little car shouldn't have forced this... the trucker is at fault for not preventing a collision that was avoidable.

The National Safety Council, defines a preventable collision as one in which the driver failed to do everything that they reasonably could have done to avoid it.

The American Trucking Association, uses the following rule to determine the preventability of a collision: “Was the vehicle driven in such a way to make due allowance for the conditions of the road, weather, and traffic and to also assure that the mistakes of other drivers did not involve the driver in a collision?”

Here on this video you can see that the trucker didn't back off, allow the car in, and prevent the collision.

I bet everyone knows that the most important rule in every US state is that you are guilty if you could have reasonably done something to prevent a collision, and didn't.

That's the law. You are at fault anytime you could have prevented a collsion and didn't. Found on http://truckviewtv.com/redneck-trucker-says-no-to-this-blonde-trying-to-merge/

  1. Jesse, I didn't know that. (embarrassed face icon here) Thank you for sharing that information!

  2. Most irresponsible driving I have ever seen. Worse than drunk driving because it was premeditated. The truck driver had more than enough time to let the car in. It is also obvious that he knew the car was there because he swerved to the left. Driving a big truck isn't a game. A good driver should act like he is responsible for safety of everyone anywhere near his rig.

  3. youd be amazed at how many people dont see an 80 foot long truck,
dash cams are great, the trucker slowed down, you can hear the change in the engine, and moved over as far as he could, when he realize the fool in the car apparently didnt look before changing lanes.

    1. yea-up. but I'm just commenting on this video, not every other example of unrelated stuff. He didn't slow that I can see, until after hitting the car. It was clear that the idiot car driver was determined to force his way in, and the trucker maintained speed til hitting the car

    2. No problem, a driver of any vehicle has no responsibility to move over and let a moron have their way, the idiot in the car is required to yield when changing lanes, you cant change lanes into the vehicle currently occupying the lane you wish to be in, and then blame it on the driver of the vehicle that YOU struck.

if truck drivers stabbed the brakes every time it looked like some idiot car was going to swerve into them, they might as well park and go home.

if I were the truck driver, Id feel confident showing the dash cam vid to any jury in the country.

    3. Well, you seem to be making stuff up. I rewatched the video, at no time can the driver be seen through the tinted window, nor does the driver ever exit the car in the video... so your guess as to hair color and sex of the driver are without basis in fact from this video. If you know something about this collision that isn't in the video, please share it. Also, as I made clear, the LAWS state that every driver must avoid a collision, and may not allow one to occur that they can prevent. This trucker drifted off the road to avoid hitting the car, but never changed his speed. Then he hit the car instead of slowing down. It's very simple, he knew the car was there as he swerved to avoid it, then he hit it when it didn't go back to it's lane. He maintained the distance between the front of his truck and the Nissan, which indicates that his semi never slowed down, and then he collided with the VW. You actually can do what that car did, and then when hit by the truck, will learn what I already told you, The National Safety Council, defines a preventable collision as one in which the driver failed to do everything that they reasonably could have done to avoid it.

The American Trucking Association, uses the following rule to determine the preventability of a collision: “Was the vehicle driven in such a way to make due allowance for the conditions of the road, weather, and traffic and to also assure that the mistakes of other drivers did not involve the driver in a collision?” You are guilty if you cause a collision you could have avoided by taking action. Sure the car is at fault for making the problem occur, but, the trucker hit the car when he could have slowed down by using brakes or a gear change to allow the pushy VW into the lane. Case closed. Trucker guilty by both the Trucking Association rule, the state laws of driving on highways, and common sense. If that doesn't make sense to you... you are upset about being wrong. Truckers have to put up with a lot of shit I wish they didn't have to, but, every trucker signed for a drivers license and agreed to OBEY EVERY driving law on the road. Not just the ones that their trucks aren't capable breaking (donuts, over 200 mph, jack rabbit starts, driving on sidewalks)

    4. you posted a video that says the driver is a "redneck" ad the car is driven by a "blonde"
      not my description.
a "preventable" accident, and a "chargeable" accident atr teo very different thing.

every trucking company calls every accident preventable, no matter what the circumstances were, a trucker can hit a deer that leaped out into the road, and the company he works for will list is as "preventable"

colliding with the idiot in the black car may have been preventable, IF the driver ever even saw the car, but I do not believe it will be a "chargeable " accident,

judging from the video, Id say the police will issue the ticket to the black car for causing the accident,

in a semi truck, you can swerve, or you can stab the brakes, but you cant do both at the same time, that will instantly cause it to jack knife,

and the trucker did NOT "hit" the car, the trucker was minding his own business in his lane and the car clearly swerves right into the side of his truck

love your blog BTW, very entertaining.

    5. Oh! That's where people are getting the blond term from... yeah, that is not from anything that can be found in the video, it's from the title on the youtube video. Got it. I still can see the trucker drift off to the left when the black VW drifts into his lane, proving he was aware of it encroaching into his lane, and him not slow down. I never said stab the brakes, I never said lock the brakes up and hope. I said use the brakes, slow down, and this collision would not have happened. But, trucker did not give way, did not let the VW get their desired lane change in front of him. We don't know about tickets, charges, or anything outside the video as consequences that occurred. We do know that the trucking association and all states have a "safe driving law" that simply says you must do everything possible to PREVENT a collsion, no matter who did what or when or where. Spoiled brat rage monsters that can't sacrifice their chosen lane, speed, or ego have to suffer the consequences when they won't back down from a collision. Hitting a car deliberately is commonly referred to as 1st degree attempted assault. But whatever, you think that you don't see the trucker drift off to the shoulder, and then hit the car in the rear door? Fine. I got no stake in this wreck. I just share the video and point out the obvious to the rest of my audience that can learn from this that NOT giving way and backing off makes you the offender, and puts you in front of a judge as the defendant in an assault and battery case where they will take away your driving privilege for deciding to damage property, and potentially causing serious harm to people.

    6. Jesse, I hate to break it to you, but you're wrong. Let me ask you this... Where in the video can you prove to me that he can see the car? Simply put, you can't. Let me point out to you the one thing that is in the video the whole time, the hood, or more specifically, the hood ornament. Where is the camera in relation to the hood ornament? It is to the right, kind of like where a passenger would be sitting, not the driver. Also, most cameras, including this one, is set high up in the windshield. Just exactly where is your eye level at when you drive your vehicle? I would venture to say right around center line.

If you are going to harp on this driver or any other driver in these videos, pay attention to everything. They are important.

    7. I am often wrong, it comes with being brave enough to speak your mind on things you have little familiarity with, etc. I reply to your 1st question with the obvious retort, where can you prove he doesn't? There is no evidence that he can or can't. Agreed?

    8. as for my harping, I suppose you hadn't noticed... this is MY site. I get to do, whatever I wish. What's your site? Do you have one, if you did - would you take orders from readers? I think not. So, as a reader, don't give orders. There you are, good chap.

    9. I still can see the trucker drift off to the left when the black VW drifts into his lane, proving he was aware of it encroaching into his lane, and him not slow down. The action of him getting out of his lane to avoid the collision is the PROOF HE CAN SEE THE CAR YOU DUMMY
So, try to take your own advice, and then shut the hell up and don't give any idiotic advice to people that are aware that you are saying something stupid.

  4. the other thing to consider here is this,
if the camera is mounted to the top center of the windshield as most dash cams are, the camera lens will have a much better view of things than the driver will, since the camera will be about 24 inches higher and about 24-30 inches further forward than the drivers eyes.

Id say if thats the case the driver was not able to see the ditzy blonde in the car

    1. Or, maybe, you'll understand if I put it clear in terms of racing rules. You cause a car to spin, you are at fault. If you make contact, you are at fault. NASCAR rule, if the other car is a fender ahead of you, they have the right of way. In this semi vs VW, the semi caused a spin, the VW was a fender ahead. Case closed

    2. Also, every state DMV rules of driving start with the following: Right of Way, Laws and rules, Yield your right-of-way when it helps to prevent collisions.

    3. This isn't NASCAR. The real world doesn't go by NASCAR rules. They go by laws such as No Passing on the Right, Failure to Merge, Causing an Accident. None of wich the trucker did, but the VW driver did.

    4. You are irritating. You must be a parent used to telling your kids how they are always wrong, and got the notion in your head to believe your own ego. Well, your limited knowledge of the "Basic Driving Law" in the USA is glaring, it's so terribly obvious you talk about things without thinking about them, and probably often talk about things without knowing what the hell you're ignorant about.
California (7th largest economy on the planet) DMV driver handbook, page one, paragraph one, 3rd sentence: Yield your right-of-way when it helps to prevent collisions.

" a basic driving law. Drivers are required to leave enough space between them and the vehicle in front of them so there is always enough room to stop safely. " https://www.fararlawgroup.com/los-angeles-car-accident-lawyers/can-i-be-found-liable-if-my-car-is-rear-ended-in-a-crash/
a “Basic Speed Law.” This law means that you may never drive faster than is safe for current conditions. https://www.dmv.ca.gov/portal/dmv/detail/pubs/hdbk/speed_limits+

    5. Also, I'm not a Nascar fan, but their rule makes sense. Like it or not, the semi driver fucked up. He proved he was aware of the car by pulling off to the left. He didn't leave enough space between himself and the car ahead, and then he did not prevent the collision. The trucker is just no better than any other motorist, he must be responsible as all other drivers must, and a trucker must not collide with anything in an incident where the rest of the world (except you and other argumentative idiots) can see he could have acted to prevent a collision. Just deal with it. And stop being an asshole
