Japanese police have suspended the car driving licenses of nearly 900 cyclists after they were caught riding bicycles under the influence of alcohol

The number of suspended car driving licenses from January to September rose sharply compared to last year, as Japan imposed new traffic laws that imposed stricter penalties on cyclists.

Under the new rules introduced in November last year, those who cycle while under the influence of alcohol can face up to three years in jail or a maximum fine of 500,000 yen ($3,200).

According to more new rules taking effect next April, cyclists will also be fined for minor offences including riding a bicycle while holding an umbrella, using their phones on the bike, ignoring traffic lights and riding without lights at night. 

The threshold for punishing tipsy cyclists was also lowered. Cyclists can be penalized if a breath alcohol test detects 0.15 milligrams per litre or higher.

More than 4,500 people across Japan were caught riding bicycles while tipsy between November 2024 and June this year, the Mainichi newspaper reported, citing police figures.

Authorities are ramping up regulations for bicycles, a form of transport that grew in popularity during the pandemic - but also led to more accidents involving cyclists.

More than 72,000 bicycle accidents were recorded in Japan in 2023, accounting for over 20% of all traffic accidents in the country, local media reported.

Alcohol has long been seen as a social lubricant for thousands of years in Japan, where business deals and difficult issues are discussed over bottles of beer and sake. It is believed that drinking alcohol creates a more relaxed environment for such discussions.

What do you readers think? What should my final response be? 

I replied via email, that though that lawyers client is uncomfortable with his past arrest for 55 in a 35, and charge with DUI, that has nothing to do with me, and is simply a historical fact. I reported on it at the time, as one does when reporting news, especially news that is ironic.

But now the DUI lawyer has his PR lawyer out trying to remove all evidence from the internet that this occurred. 

So, what's your advice?

Delete the original post? Or point out the freedom of the press? Or something else?

Even though the DUI charges were dismissed, there is still a pending civil charge against Maloney for refusing to submit to a sobriety test. Under Florida law, drivers who do not submit to a sobriety test can have their license revoked for up to a year. In most situations, if you refuse to take a mandatory sobriety test, you cannot be forced to do so; however, that does not mean that you cannot be convicted of a DUI. The state does not have to prove that your blood alcohol level was over 0.08 and can use other evidence such as erratic driving, slurred speech, and can even use the refusal to take a blood alcohol test as evidence for a conviction of a DUI.

No surprise, as anyone with 8 previous convictions of drunk driving, is a drunk driver, and will repeat that behavior as long as they can drink alcohol, they have a vehicle, and there is fuel in the tank.

Palmersheim's attorney said she had sold her house and liquidated retirement savings to pay for treatment, had completed an intense recovery program, was working and was living in a sober house.

Montana lawmakers in 2021 enhanced the penalties for fourth and subsequent DUI convictions, but this incident occurred in 2020. The maximum allowed then was five years in prison or DOC custody.

Palmersheim’s daughter said via video from Texas that her mother had struggled with mental health issues and addiction for most of her life.

She said Palmersheim entered an inpatient treatment program after the DUI in Texas and finally received a comprehensive evaluation and proper diagnosis. “I have seen the court systems and the medical systems fail her over and over again, and she was sick,” the daughter said.

what a drunk driver doesn't know is how obvious it is that that are not well enough to be driving a guided missile in public, endangering people who are unaware they are in danger. Here is one drunk I fell fine about putting on public blast

not only is he passed out, head on steering wheel, engine still running, vomit on the ground

but he also parked on the sidewalk. 

no one is safe, really, because of all the people out there driving, some are drunk, some are uninsured, some are driving on tires that are underinflated, or bald and some are driving while enraged at someone that is arguing with them, or breaking up with them, some are inexperienced, and some are just terrible drivers. 

So make sure YOU are insured, have good tires properly inflated, and are pretty focused on the driving when you're on the road. Stay aware of the traffic around you as some of them might be about to cause a collision at any time, and the more we've gotten accustomed to driving the more we lose our caution. 

Be cautious my friends, but not nervous. Be alert, but not paranoid.
